Description

O decreto estabelece definições e procedimentos sobre o controle de qualidade da água de sistemas de abastecimento e institui mecanismos e instrumentos para divulgação de informação ao consumidor sobre a qualidade da água para consumo humano.
O decreto também aprova o Regulamento Técnico sobre Mecanismos e Instrumentos para Divulgação de Informação ao Consumidor sobre a Qualidade da Água para Consumo Humano.

The decree should guide the surveillance guidelines for the state and municipal health secretariats, as well as direct and influence actions of the Secretariat of Indigenous Health (SESAI) and Funasa.

Implementation Strategy

The decree assigns the following competence to the health bodies responsible for monitoring the quality of drinking water:

I - keep up-to-date records on the characteristics of the distributed water, systematized in a way that is understandable to the general population and made available for ready access and public consultation;
II - have mechanisms to receive complaints regarding the characteristics of the water, to adopt appropriate measures;
III - guide the population on the procedures in case of situations of risk to health; and
IV - coordinate with the National, State, the Federal District, Territories and Municipal Councils of Health, Sanitation and Environment, Water Resources, River Basin Committees and other entities representing civil society.

Diffusion strategies

The decree establishes principles of transparency with the public, as provided in its Article 3:

Art. 3 The agencies and entities of the States, Municipalities, the Federal District and Territories and other legal entities, to which this Decree applies, must send information to consumers about water quality, within the following deadlines:

I - monthly information in the water bill, in compliance with items "a" and "b" of item I of art. 5 of the Annex, as of June 5, 2005;

II - monthly information in the water bill, in compliance with items “c" and “d" of item I of art. 5 of the Annex, as of March 15, 2006; and

III - annual report by March 15 of each year, except for the first report, which will have the deadline of October 1, 2005.

Monitoring strategies

The Ministries of Health, Justice, Cities, Environment and Climate Change, and state, municipal, Federal District and Territories authorities will be responsible for monitoring and adopting the necessary measures to comply with the provisions of Decree 5440/2005.
